  • Families with several beneficiaries. We act for the executor and, at the executor's direction, keep beneficiaries informed.
  • Executors who live outside Newfoundland and Labrador and need a local contact for the property.
  • Homeowners downsizing to a smaller home, with help on both the sale and the search for the next home.

What are the steps to sell an estate property in St. John's?

Every estate is different, and your lawyer will confirm what applies to yours. On the real estate side, executors typically work through these steps with us:

  1. Start with an initial consultation and property review. The process begins with a conversation about the estate situation, timeline, and any legal considerations such as probate. During this stage the property is reviewed, its condition discussed, and the steps required before listing outlined. We suggest getting in touch one to two months before you plan to list.
  2. Secure the property. Make sure the home is locked, checked regularly and heated through the colder months, and speak with the insurer about coverage while it is vacant.
  3. Confirm your authority to sell. In many cases, probate is required before an executor can sell estate property, as it confirms the executor's legal authority to act on behalf of the estate. However, every situation is different, so your estate lawyer will confirm what applies and who needs to sign.
  4. Understand the value and the pricing strategy. We prepare a no-obligation comparative market analysis of the property to determine its current value. Estate properties often require thoughtful pricing strategies, depending on the condition of the property, market conditions and the executor's responsibilities. A CMA is not a formal appraisal. If the executor or the estate lawyer needs an appraisal for estate purposes, they can arrange one separately.
  5. Prepare the property for sale. Many estate homes need preparation before going to market. We help you decide what is worth doing before listing, from clearing belongings to staging, or whether to sell as-is. We also help coordinate services such as cleaning, minor repairs, painting, decluttering and staging when appropriate, so the home is presented in the best possible light. We can keep family members informed at the executor's direction.
  6. Use strategic marketing and exposure. Once the property is ready, we list it on the MLS® System through Keller Williams Platinum Realty and market it professionally, with digital marketing (including drone and video where appropriate) and targeted exposure to qualified buyers, to give it strong visibility in the market. We handle showings on behalf of the executor.
  7. Review offers and negotiate. When offers are received, we guide the executor through the review process, explain the terms and conditions clearly, and negotiate on the executor's behalf to protect the interests of the estate.
  8. Coordinate closing. After an agreement is reached, we coordinate with the executor, the estate lawyer and other professionals involved so all details are handled smoothly through to closing. We can also recommend packing and moving services so the home is empty before closing.

Do executors get access to a trusted professional network?

Settling an estate often involves coordinating with multiple professionals, including lawyers, accountants, financial advisors and service providers. Having the right team in place helps ensure the process is handled efficiently and with proper attention to legal and financial considerations.

As a Certified Executor Advisor (CEA), Natasha understands the broader responsibilities executors face and works collaboratively with trusted professionals when needed. Whether that means coordinating with legal counsel, recommending qualified local service providers or helping manage the preparation of a property for sale, the goal is to make sure the real estate portion of the estate process is handled smoothly and responsibly.

Questions From Executors and Families

A Certified Executor Advisor has specialized training in supporting executors and families through the real estate aspects of estate administration. At L|S Real Estate Group, co-founder Natasha Sutherland holds the CEA designation. She helps executors secure, value, prepare and sell an estate property, and works alongside the estate's lawyer, accountant and financial advisors. She does not provide legal or tax advice.

No. L|S Real Estate Group supports the real estate side of the estate process only. Questions about the will, probate, taxes and how proceeds are distributed should go to the estate's lawyer and accountant. We work alongside them, share the property information they need, such as a comparative market analysis, and keep the executor informed so the sale fits the estate's legal and financial timeline.

In many cases, probate is required before an executor can sell estate property, as it confirms the executor's legal authority to act on behalf of the estate. However, every situation is different, and it can depend on how the property was owned and whether there are surviving joint owners. This is not legal advice — confirm with your lawyer before you list.

A property can often be prepared, and sometimes conditionally listed, while probate is pending, but the sale typically cannot be completed until probate has been granted, which can be a deterrent for potential buyers. Your estate lawyer should confirm when you can list and when the sale can close; this is not legal advice. Many executors use the waiting period to secure the property, get a market valuation and prepare the home, and L|S Real Estate Group can plan those steps with you.

The value of an estate property is usually determined through a comparative market analysis, which reviews recent sales of similar homes in the area, current market conditions and the condition of the property itself. A comparative market analysis is not a formal appraisal. In some cases, an executor or lawyer may also request a formal appraisal to establish value for estate purposes.

Estate properties are often sold in "as-is" condition, particularly if the executor does not have full knowledge of the home's history or condition. Selling as-is lets buyers assess the property themselves and helps reduce liability for the estate, while some homes benefit from cleaning, decluttering or small repairs before listing. We compare the likely outcomes using a comparative market analysis, so the executor can make an informed decision. Your estate lawyer can confirm whether beneficiaries need to approve the sale. This is not legal advice — confirm with your lawyer, including how an as-is sale affects the estate.

Preparing an estate home for sale may include clearing personal belongings, arranging cleaning or minor repairs, and ensuring the property is safe and presentable for showings. In some cases, small improvements or staging can help improve the property's appeal to buyers.

When multiple beneficiaries are involved, the executor is responsible for managing the sale of the property in accordance with the will and applicable estate laws. Clear communication and transparency throughout the process can help ensure that all parties understand the steps being taken and the decisions involved in the sale. We act for the executor and, at the executor's direction, keep beneficiaries informed. This is not legal advice — confirm with your lawyer.

In most cases, the executor has the legal authority to manage estate assets, including selling property, as long as they are acting in accordance with the will and their legal responsibilities. However, executors often keep beneficiaries informed throughout the process to maintain transparency and avoid misunderstandings. Your estate lawyer can confirm whether beneficiaries need to approve the sale. This is not legal advice — confirm with your lawyer.

Costs can include real estate commission, legal fees, adjustments for property taxes or utilities, a pre-inspection (optional) and any expenses related to preparing the property for sale. We recommend reviewing these with your lawyer and your REALTOR® before you list. This is not legal or tax advice — confirm with your lawyer and accountant.

The timeline can vary depending on factors such as probate timelines, the condition of the property, market conditions, and whether preparation work is required before listing. Once a property is ready to be listed on the market, the sale timeline is often similar to other residential real estate transactions.

We suggest contacting us one to two months before you plan to list. That leaves time to review the property, discuss its condition and the steps your lawyer outlines, and prepare the home. There is no single timeline that fits every estate: probate and the condition of the property can both affect timing.
